Terms of Service

These terms cover how we work together — what we build, what you pay, who owns what, and what happens if you decide to leave. We have tried to write them in plain English. If anything here is unclear, email us before you sign up and we will explain it.

Who We Are

Anchored Development LLC is a web development company based in Navarre, Florida. You can reach us at [email protected]. In these terms, "we" and "us" mean Anchored Development LLC, and "you" means the person or business we are building a site for.

What We Offer

We offer two ways to get a website built:

• Free builds. For personal sites and small business static sites of up to five pages, we design and build your site at no charge. There is no setup fee, design fee, or build fee.
• Paid development tiers. For larger or more complex projects — custom design, content management, integrations, or anything beyond a straightforward static site — we quote the work up front.

Every site we host runs on a monthly plan. Which way your site was built determines who owns it, and that is covered below.

What You Always Own

Regardless of how your site was built, and regardless of whether you are still a customer:

• Your domain name. Your domain is registered in your name, or we will transfer it to you free of charge whenever you ask. It is yours to point anywhere.
• Your content. Your text, photographs, logo, branding, and any other material you give us remains yours. You are giving us permission to use it on your site, nothing more.
• Your data. Contact form submissions, customer enquiries, and any other information your site collects belong to you. We will export it to you on request at no charge, whether or not you are leaving.

Ownership of Free Builds

When we build your site at no charge, we retain ownership of the site's source code, templates, and design. Your monthly plan grants you a licence to use that site for as long as your plan is active. This is the trade that makes a free build possible: we take on the development cost, and we recover it over time through the monthly plan rather than charging you for it up front.

In practice this means the source code is not transferred to you and the site is not yours to move to another host. If ownership matters to you, that is what the paid development tiers are for, and you can move to one at any time — see Taking Ownership below.

Ownership of Paid Builds

When you pay for development, the finished site is yours. On final payment we transfer ownership of the source code and design to you, and we will hand over the project files on request. You are free to host it with us, host it elsewhere, or hand it to another developer. Any third-party components, fonts, stock imagery, or open-source libraries remain subject to their own licences.

Taking Ownership

If you started with a free build and later want to own your site outright, you can move to a paid development tier at any time. Once that is paid, ownership of the code and design transfers to you under the terms above. Talk to us first — the right tier depends on what your site has grown into, and we will quote it before you commit to anything.

Monthly Plans & Billing

• Plans are billed monthly, in advance, on the first day of each month.
• Your first month is pro-rated. You are charged only for the days between your site going live and the end of that month, so you never pay for time before your site existed.
• Plan prices are listed on our pricing page. If we change the price of your plan, we will give you at least 30 days' notice, and you are free to cancel before it takes effect.
• If a payment fails, we will let you know and give you a reasonable window to sort it out before treating the plan as cancelled.

Cancellation

There is no contract and no minimum term. You can cancel at any time by emailing us. When you do:

• Your site stays live through the end of the month you have already paid for. We do not cut you off mid-month.
• At the end of that period, your site comes offline and billing stops. Monthly fees already paid are not refunded, including the month you cancel in.
• We keep a full backup of your site for 90 days. If you change your mind within that window, we can restore it and put you straight back online. After 90 days the backup is deleted.
• Your domain, your content, and your data go with you, as described in What You Always Own above. On a free build, the site's code and design stay with us.

We may also end a plan ourselves — for non-payment, or for the conduct described under Acceptable Use — and we will give you notice and a chance to put things right first wherever it is reasonable to do so.

Your Responsibilities

You are responsible for the content you give us. By providing it, you confirm that you own it or have permission to use it, and that it does not infringe anyone else's rights. You agree to review what we build and tell us promptly if something is wrong. Projects need your input to move forward, and we cannot hit a timeline if we are waiting on content or feedback.

Acceptable Use

You may not use a site we host for anything unlawful, for malware or phishing, for bulk unsolicited email, for content that infringes someone else's rights, or for anything that puts our hosting or other customers at risk. We reserve the right to take a site offline if it is being used this way.

Uptime & Availability

We host on reliable infrastructure and we work hard to keep your site fast and available, but we do not guarantee uninterrupted service. Hosting providers, domain registrars, and other third-party services occasionally fail, and some things are genuinely outside our control. We will tell you when we know about a problem and fix what is ours to fix.

Limitation of Liability

Our services are provided as-is, without warranties beyond those required by law. To the fullest extent the law allows, we are not liable for lost profits, lost business, or other indirect or consequential damages. Our total liability for any claim relating to our services is limited to the amount you paid us in the twelve months before the claim arose.

Governing Law

These terms are governed by the laws of the State of Florida, and any dispute will be handled in the courts of Santa Rosa County, Florida.

Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated "Last updated" date. If a change materially affects an active plan, we will let you know directly.
