These terms cover how we work together — what we build, what you pay, who owns what, and what happens if you decide to leave. We have tried to write them in plain English. If anything here is unclear, email us before you sign up and we will explain it.
These terms are for website and app projects. Spyglass, our developer dashboard, and its integrations have their own Spyglass terms of use.
Who We Are
Anchored Development LLC is a web development company based in Navarre, Florida. You can reach us at contact@anchoreddev.com. In these terms, "we" and "us" mean Anchored Development LLC, and "you" means the person or business we are building a website or app for.
What We Offer
We design and build websites and apps, and we host and look after them on a monthly plan:
- Builds are quoted per project. Before any work begins, we agree what we will build and a fixed price for it, and you pay for the build separately from the monthly plan.
- Every website and app we host runs on a monthly plan. Apps also carry their direct costs, passed through at cost (see Direct Costs for Apps).
Boo at the Zoo Websites
Websites reserved through our Boo at the Zoo promotion, during the dates shown on the event page, are the exception to the rules above about build quotes and minimum terms:
- One price, no build fee. The basic website described on the Boo at the Zoo page is covered by its monthly plan, with no setup fee and no other required fee for the included package. Anything beyond that package is quoted separately, and needs your approval before any work or charge.
- A reserved rate. Submitting the reservation form holds the promotional rate for your business. It doesn't charge you and it isn't the service agreement. The rate stays reserved if your build starts after the promotion ends.
- An initial commitment. Before work begins you review and accept a service agreement that sets out the twelve-month initial commitment, the cancellation fee that applies if you cancel before it ends (the same fee shown on the Boo at the Zoo page), when billing starts (when your site goes live), and how the project is reviewed and approved. After the initial commitment the price stays the same and you can cancel at any time. That agreement, not this page, governs a Boo at the Zoo website.
- Approval before publishing. Nothing is published until you approve a specific version, and silence is never treated as approval.
Ownership works as described below: you keep your domain, content and data, and we keep the code and design.
What You Always Own
Whatever we build for you, and regardless of whether you are still a customer:
- Your domain name. Your domain is registered in your name, or we will transfer it to you free of charge whenever you ask. It is yours to point anywhere.
- Your content. Your text, photographs, logo, branding, and any other material you give us remains yours. You are giving us permission to use it on your site or app, nothing more.
- Your data. Contact form submissions, customer enquiries, and any other information your site or app collects belong to you. We will export it to you on request at no charge, whether or not you are leaving.
What We Own
We retain ownership of the source code, templates, and design of every website and app we build, including when you have paid for the build. The build fee pays for the work of creating it; it does not transfer ownership. Your monthly plan grants you a licence to use your site or app for as long as your plan is active.
In practice this means the source code is not transferred to you and the site or app is not yours to move to another host. If ownership matters to you, you can buy it outright at any time — see Taking Ownership below. Any third-party components, fonts, stock imagery, or open-source libraries remain subject to their own licences.
Taking Ownership
If you want to own your site or app outright, ask us for a buyout. We will quote it before you commit to anything. Once the buyout is paid, ownership of the code and design transfers to you and we will hand over the project files on request. You are then free to host it with us, host it elsewhere, or hand it to another developer.
Plans & Billing
- Plans are billed monthly, in advance, on the first day of each month.
- Your first month is pro-rated. You are charged only for the days between your site or app going live and the end of that month, so you never pay for time before it existed.
- Plan prices are listed on our homepage. If we change the price of your plan, we will give you at least 30 days' notice, and you are free to cancel before it takes effect.
- If a payment fails, we will let you know and give you a reasonable window to sort it out before treating the plan as cancelled.
Direct Costs for Apps
Apps depend on services that a website usually doesn't need, such as hosting with a database, third-party APIs, and their own domains. These are your app's direct costs. We pass them through at exactly what we pay, with no markup, itemized on your invoice. We estimate them before work begins, but they follow the providers' prices and how much your app is used, so they can vary from month to month.
Cancelling a Plan
There is no contract and no minimum term, except for a Boo at the Zoo website, whose initial commitment and early-cancellation fee are set out in its service agreement. You can cancel at any time by emailing us. When you do:
- Your site or app stays live through the end of the month you have already paid for. We do not cut you off mid-month.
- At the end of that period, it comes offline and billing stops. Monthly fees already paid are not refunded, including the month you cancel in. An app's direct costs up to that point are still billed at cost.
- We keep a full backup for 90 days. If you change your mind within that window, we can restore it and put you straight back online. After 90 days the backup is deleted.
- Your domain, your content, and your data go with you, as described in What You Always Own above. Unless you have bought it outright, the code and design stay with us.
We may also end a plan ourselves — for non-payment, or for the conduct described under Acceptable Use — and we will give you notice and a chance to put things right first wherever it is reasonable to do so.
Your Responsibilities
You are responsible for the content you give us. By providing it, you confirm that you own it or have permission to use it, and that it does not infringe anyone else's rights. You agree to review what we build and tell us promptly if something is wrong. Projects need your input to move forward, and we cannot hit a timeline if we are waiting on content or feedback.
Acceptable Use
You may not use a site or app we host for anything unlawful, for malware or phishing, for bulk unsolicited email, for content that infringes someone else's rights, or for anything that puts our hosting or other customers at risk. We reserve the right to take a site or app offline if it is being used this way.
Lead Current
We discontinued Lead Current, our new-homeowner lead service, in October 2026, and no longer take subscriptions for it. Lists it already sent remain subject to the Lead Current terms that applied when they were sent; email us for a copy.
Uptime & Availability
We host on reliable infrastructure and we work hard to keep your site or app fast and available, but we do not guarantee uninterrupted service. Hosting providers, domain registrars, and other third-party services occasionally fail, and some things are genuinely outside our control. We will tell you when we know about a problem and fix what is ours to fix.
Limitation of Liability
Our services are provided as-is, without warranties beyond those required by law. To the fullest extent the law allows, we are not liable for lost profits, lost business, or other indirect or consequential damages. Our total liability for any claim relating to our services is limited to the amount you paid us in the twelve months before the claim arose.
Governing Law
These terms are governed by the laws of the State of Florida, and any dispute will be handled in the courts of Santa Rosa County, Florida.
Changes to These Terms
We may update these terms from time to time. Changes will be posted on this page with an updated "Last updated" date. If a change materially affects an active plan, we will let you know directly.
